These Terms of Service (“Terms”) govern your use of btsbrands.com (the “Site”) and your purchase of services and products from Built to Suit Brands, LLC (doing business as BTS Brands, “BTS,” “we,” “us”), a Florida limited liability company. By using the Site or placing an order, you agree to these Terms. If you have a separate signed agreement with BTS, that agreement controls where it conflicts with these Terms.
Services
BTS provides commercial real estate marketing services, including retainer hour blocks, monthly virtual marketing department engagements, website design, development and hosting, automation, and digital templates. Service descriptions, inclusions, and pricing are stated on the Site at the time of purchase; the scope purchased is the scope stated.
Retainer hours & monthly engagements
- Retainer blocks are one-time purchases of production hours drawn down as work is performed. Hours are not transferable to another firm.
- Monthly engagements (virtual marketing department, hosting) renew monthly at the stated rate until canceled. Cancellations take effect at the end of the current billing period.
- Rush work, scope beyond the stated inclusions, and third-party costs (stock assets, licenses, ad spend) are billed separately and approved with you before they’re incurred.
Templates & digital products
- Template purchases grant your firm a non-exclusive, non-transferable license to use, edit, and produce derivative deliverables from the template for your own business and your clients’ listings.
- You may not resell, redistribute, sublicense, or offer the template (or a renamed derivative of it) as a template, whether free or paid.
- All template sales are final and non-refundable. Templates are digital goods delivered as editable working files; a defective file will be replaced or repaired, but purchases are not refunded.
Client materials & deliverables
You represent that materials you supply for production (data, photography, logos, copy) are yours to use and don’t infringe third-party rights. Upon full payment, custom deliverables produced for you are yours. BTS retains its pre-existing tools, processes, template architecture, and know-how, and may display completed work in its portfolio unless you ask us not to.
Payment
Prices are in U.S. dollars as listed at checkout or in your engagement. Payments are processed by third-party processors; we do not store full card numbers. Overdue invoices may pause active work. All sales are final; BTS does not issue refunds. Applicable taxes are your responsibility where required by law.
Websites & hosting
Website packages include the development hours and inclusions stated on the package page. Hosting tiers include the stated infrastructure and support levels; they are monthly services that renew until canceled. We target continuous availability but do not guarantee uninterrupted service, and scheduled maintenance may occur.
Acceptable use
You agree not to misuse the Site — no unlawful use, no attempts to breach security, scrape at scale, or interfere with service to others.
Disclaimers
The Site and its content are provided “as is.” Marketing outcomes depend on factors beyond any agency’s control, and BTS does not guarantee specific business results (leads, rankings, sales). Nothing on this Site is investment, legal, or brokerage advice.
Limitation of liability
To the maximum extent permitted by law, BTS’s total liability arising out of any engagement or use of the Site is limited to the amounts you paid BTS for the service giving rise to the claim in the twelve (12) months preceding it, and BTS is not liable for indirect, incidental, or consequential damages, including lost profits.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Venue for disputes lies in the state or federal courts located in Hillsborough County, Florida.
Changes
We may update these Terms from time to time; the effective date above reflects the latest revision. Continued use of the Site after changes are posted constitutes acceptance.
